Toronto (Canada) – Fasken was highlighted as a key player in multiple cases in Lexpert’s Top 10 Business Decisions of 2022/2023. The list is based on an assessment of the most significant Canadian legal cases with decisions released between Oct. 1, 2022, and Sept. 30, 2023.
Of the top ten 10 cases recognized, the Firm acted on the following:
In Workman Optometry Professional Corporation et al. v. Certas Home and Auto Insurance et al., 2023 ONSC 3356, the Fasken team was led by Sarah Armstrong and David Rosenbaum and included Jesse Harper, Daanish Samadmoten, Rachel Laurion, Kimberly Potter, Sebastien Richemont, Vincent Cerat-Lagana and Andrew Borrell, who represented Intact Insurance Company, Novex Insurance Company and Royal & Sun Alliance Insurance Company of Canada (together, “Intact”) in connection with their defence of a series of proposed class actions and individual actions across the country relating to business interruption insurance claims arising out of COVID-19 closures. Intact is the largest provider of property and casualty insurance in Canada.
In Groupe Sélection Inc.’s restructuring under the Companies’ Creditors Arrangement Act, the Fasken team was led by Alain Riendeau and Brandon Farber, and included Nicolas Leblanc, Christine Provencher and Éliane Dupéré-Tremblay, who acted for PricewaterhouseCoopers Inc. in its capacity as court-appointed monitor with expanded powers to implement the proposed restructuring.
Our team, led by Kibben Jackson, Glen Nesbitt and Tom Posyniak, also acted for the Insolvency Institute of Canada (“IIC”) as intervener in Peace River Hydro Partners v. Petrowest Corp., 2022 SCC 41. The IIC was granted intervener status in this case to provide the Supreme Court of Canada with the perspective and expertise of insolvency practitioners across the country.
