Zhejiang Machinery Import & Export Corp. didn’t adequately rebut a presumption of de facto government control to qualify for a special antidumping duty rate, a federal appeals court affirmed on Friday.

Though the company previously had a separate rate status for tapered roller bearings, a Department of Commerce review of the company’s corporate structure found that ZMC “failed to rebut the presumption of de facto government control over its export activities,” the US Court of Appeals for the Federal Circuit said.
